CHAPTER 7. FIRECHAPTER 7. FIRE\Article 4. Firefighter’s Relief Association

The Firefighter’s Relief Association shall be composed of all active members of the Fire Department. Quitting the service by any member or his/her dismissal for cause shall automatically end his/her membership in this association and forfeit to the association all his/her rights in all monies, fund and investments held or controlled by the Association. Disobedience of this Article or the rules and bylaws adopted by the association or violation of State law shall require dismissal from this Association.

The officers shall consist of a President, Vice President and Secretary-Treasurer. These five (5) shall constitute the Board of Directors. Each officer shall perform the customary duties of his/her office. Subject to the approval of the Governing Body, the Association, for its regulation and direction, shall adopt suitable bylaws, rules and regulations as it may deem advisable in carrying out and promoting the objects of said Association, not inconsistent with this Article, the laws of the State of Kansas, or the rules and regulations of the Commissioner of Insurance. In addition to his/her other duties, the Secretary-Treasurer shall keep a complete record of the transactions of the Association, which shall at all times be subject to inspection by the Governing Body. The Board of Directors shall comply with Article 62 of Chapter 17 of the Kansas Statutes Annotated, by designating by resolution a resident agent and registered office in the State of Kansas and filing the same with the Secretary of State of the State of Kansas.

Each new member of the Fire Department shall become a member of this Association.

All money received by virtue of State law for the objects and purposes of this Association and all rewards of money, fees, gifts and all forfeitures, penalties or emoluments of every kind or nature that may be paid, given or forfeited to the Fire Department and all money netted from the giving of balls, exhibitions, entertainments, etc., except such money as by Article (10a) of Chapter 14 of the Kansas Statutes Annotated, shall be required to be paid into and become a part of the Firefighter’s Relief Funds. All such funds shall be held in trust and used solely for the purposes and objects of this Association as authorized by State law and in accordance with this Article and the Charter and bylaws of the Association.

The Treasurer shall be custodian of all the Association’s funds and shall deposit the same in a firefighter relief fund and be liable on his/her bond for the security of such fund, said bond to be given for the safe keeping of such funds and for faithful performance and in such sum and with such sureties as may be approved by the Governing Body. All interest paid on such fund shall be credited thereto by such Treasurer. The Treasurer shall pay out such funds only upon the warrant of the Association, signed by the President, countersigned by the Secretary, and bearing the Seal of the Association. The Treasurer shall, prior to April first (1st) of each year, prepare on such forms as may be supplied by the Commissioner of Insurance, a financial statement showing in full receipts and disbursements and general condition of the Firefighter’s Relief Tax Funds received by the Association for the year ending on the preceding December thirty-first (31st). The statement shall be verified by the Treasurer and returned to the Commissioner of Insurance on or before April first (1st). A copy of this report shall be filed with the City Clerk.

The Board of Directors may invest and reinvest up to ninety percent (90%) of the Association’s funds in bonds, as authorized by State law. It shall be the duty of the City Attorney to examine all such bonds as to their validity and report thereon in writing to the Governing Body and the Firefighter’s Relief Association, and no bonds shall be purchased until they have been approved and found valid by the City Attorney. However, the Board of Directors may loan its funds to the City to be used for the improvement and equipment of the Fire Department and receive the City’s warrant therefor bearing not more than six percent (6%) interest per annum, payable semiannually.

The Board of Directors, out of the Association’s funds, may purchase and carry insurance, as permitted by law, in such amounts as the Board with the approval of a majority of the active members, deems advisable. The City Attorney, upon request, shall advise with the Board in the purchase of such insurance.

In all cases involving expenditures or payments in an amount of one thousand five hundred dollars ($1,500.00) or more prior certification shall be obtained from the City Attorney that such expenditure complies with the requirements of Chapter 40, Article 17 Kansas Statutes Annotated.
